What Exactly Qualifies?

Building Size

The size of the building is factored into the level of deduction calculated when applying for 179D. Percentage of Efficiency

For example, HVAC systems need to meet only a 15% savings mark to be eligible for $0.60 per square foot. This also applies to a 25% savings for lighting and 10% for the building envelope system.

Certification

According to irs.gov, “Certification must be obtained to verify that the property installed satisfies the energy efficiency requirements of section 179D.” It is also important that you, the taxpayer, get said certificate before claiming your deduction.

To be eligible, a contractor or engineer must analyze the edifice in detail, on-site as well as through modeling, and award a designated compliance certificate.

Government Buildings

While government buildings are not eligible for the 179D tax deduction, architects, engineers, and possibly even contractors involved in the property designs individually can be. Per the IRS, certain deductions are allocated to those who have designed municipal buildings that meet the efficient standards defined in these regulations.

Aside from a letter from the government agency in question, these detailed energy savings must also be certified by a third party. According to the tax code, you can retroactively claim work you have done up to three years prior.

45L Tax Credit

Also notable, the 45L Tax Credit applies for owned and occupied, as well as rental, units or “dwellings.” Housing is three stories or less and consists of one room or more, a kitchen, and is intended for general living, sleeping, and sanitation. The 45L Tax Credit allows upwards of $2,000 for each unit or home.
